These Terms and Conditions define the rules for using the videolify online platform (“Platform”), which enables the creation and sharing of video galleries.
The owner and administrator of the Platform is dc media – Kornel Berne, entered into the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for economic affairs, NIP 6751699535, REGON 382884017, hereinafter referred to as the “Service Provider”.
A Platform User is any natural person, legal person, or organizational unit using the Platform’s services (“User”).
These Terms and Conditions are available free of charge on the Platform’s website in a form that allows them to be saved, stored, and printed.
The Platform operates in accordance with applicable laws, including:
Regulation (EU) 2022/2065 of the European Parliament and of the Council (DSA),
Directive (EU) 2019/2161 of the European Parliament and of the Council (Omnibus Directive).
Gallery – a collection of video materials shared by the User.
Points – settlement units purchased by the User for the purpose of creating galleries (1 point = $0,5 net).
User Account – an individual panel assigned to the User upon registration.
Gallery activity period – the period during which the gallery remains available, up to a maximum of 12 months.
The provisions concerning consumers contained in these Terms and Conditions also apply to a natural person concluding an agreement directly related to their business activity, where the content of that agreement indicates that it does not have a professional character for that person, resulting in particular from the subject of the business activity (in accordance with the CEIDG entry).
In such cases, the entrepreneur is entitled, among others, to the right to withdraw from the contract under the rules applicable to consumers.
To use the Platform, the User is required to create a User Account.
Registration is carried out by completing the registration form and accepting these Terms and Conditions.
The User is required to provide data that is accurate and consistent with the actual state of affairs.
The User Account is non-transferable.
Registration is permitted only for persons who are at least 18 years old.
The User is responsible for the security of their account and password. All actions performed using the User Account are deemed to be actions of the User.
The User undertakes to provide truthful personal data and not to create accounts in the name of other persons or provide data of another company without its consent.
The Platform enables, in particular:
uploading video files with a size of up to 200 GB,
creating galleries with a total video duration of up to 120 minutes,
sharing galleries with clients for a period not exceeding 12 months,
using additional features: comments, branding, watermark, password protection, video download option.
As part of the service provision, the Platform automatically creates HLS versions (HTTP Live Streaming) of the uploaded materials in order to ensure the best possible viewing experience for clients. The User consents to this.
Each new User is granted the ability to create one free test gallery. After the set period expires, the gallery expires, and the possibility of using the free gallery is renewed.
The Platform operates on a points-based model.
The User purchases points, which are exchanged for the ability to create galleries.
The value of 1 point = $0,50 net.
The minimum purchase is 10 points.
Points are automatically credited to the account after payment is recorded.
A VAT invoice may be issued for each purchase – in the case of business customers who provide billing details. Private individuals receive a purchase confirmation.
Point refunds:
A refund for purchased points is possible only if none of the points from a given transaction have been used.
In the case of consumers: if the User has used even one point from a given transaction, the right to withdraw from the contract does not apply in accordance with regulations governing the provision of digital services.
In the case of companies (B2B), analogous rules apply – refunds are possible only for entirely unused points.
The Service Provider reserves the right to charge an additional fee for a gallery if the videos contained therein are viewed more than 300 times within a single calendar month.
The User bears full responsibility for the content shared on the Platform and declares that they hold all copyrights or appropriate licenses to the uploaded materials.
It is prohibited to publish content that is: pornographic, erotic, depicting violence, hatred, discrimination, or violating the personal rights of third parties, as well as content that is unlawful or contrary to good morals.
It is prohibited to introduce malware, viruses, or other tools harmful to the Platform, as well as attempts to bypass the points system or disrupt the proper functioning of the Platform.
It is prohibited to resell galleries created on the Platform to other persons or filmmakers outside the Platform’s system.
The User may delete their account at any time. Account deletion results in the permanent removal of all created galleries and uploaded content, as well as:
in the case of B2B customers – forfeiture of all unused points,
in the case of consumers – a refund for unused points only if none of the points from a given transaction have been used.
In the event of a breach of these Terms and Conditions, the Service Provider reserves the right to block or delete the account. In the case of consumer accounts, unused points will be refunded in accordance with applicable law, provided that no point from the relevant transaction has been used.
The Service Provider respects the provisions of the Digital Millennium Copyright Act (DMCA) of 1998 as well as applicable Polish and international copyright law. In the event of a copyright infringement notice submitted by a third party, the Service Provider reserves the right to immediately remove the material from the Platform.
The User has the right to submit complaints regarding the operation of the Platform to the following email address: info@videolify.com.
Complaints are reviewed within 14 business days.
The consumer has the right to withdraw from the purchase of points within 14 days of purchase, provided that the points have not been used.
The right of withdrawal does not apply if the service has been fully performed with the consumer’s explicit consent before the withdrawal period has expired.
The Service Provider shall not be liable for any losses, damages, data loss, interruptions in the operation of the Platform, or other consequences resulting from the User’s use of the Platform, including actions of third parties or technical issues on the User’s side.
The Service Provider processes Users’ personal data in accordance with GDPR regulations and personal data protection laws.
Details regarding data protection can be found in the Privacy Policy available on the Platform’s website.
The Platform provides its services electronically via the internet, enabling the creation and sharing of video galleries and the management of settlement points.
The provision of services begins at the moment points are credited to the User Account or a gallery is created, in accordance with the order.
The User agrees that all information and confirmations related to the use of the Platform are delivered electronically.

All questions, technical issues, and complaints related to the use of the Platform may be sent by the User to the following email address: info@videolify.com
The Service Provider undertakes to respond within 14 business days.
The Service Provider reserves the right to amend these Terms and Conditions. Users will be informed of any changes at least 14 days before the changes take effect.
Matters not regulated by these Terms and Conditions shall be governed by Polish law.
Any disputes shall be resolved by the court having jurisdiction over the Service Provider’s registered office, unless mandatory legal provisions provide otherwise.
